Article 168
Formation of Provincial Council of Ministers
(1) The head of the state shall appoint the leader of the parliamentary party with the majority in the state assembly as the chief minister and the state council of ministers shall be formed under his chairmanship.
(2) In the event that no party has a clear majority in the Provincial Assembly in accordance with sub-section (1), the Chief Minister shall appoint the member of the Provincial Assembly who can obtain a majority with the support of two or more parties represented in the Provincial Assembly.
(3) If the Chief Minister cannot be appointed in accordance with sub-section (2) within thirty days from the date of the announcement of the final result of the provincial assembly election, or if the appointed chief minister fails to receive a vote of confidence as per sub-section (4), the provincial head shall appoint the leader of the parliamentary party with the most members in the provincial assembly as the chief minister. will appoint .
(4) The Chief Minister appointed under sub-section (2) or (3) shall obtain a vote of confidence from the Provincial Assembly within thirty days of his appointment.
(5) If the Chief Minister appointed as per sub-section (3) fails to receive the vote of confidence as per sub-section (4), if any member as per sub-section (2) is able to receive the vote of confidence in the provincial assembly, the head of the province shall appoint such member as the chief minister.
(6) The Chief Minister appointed as per sub-section (5) shall receive a vote of confidence as per sub-section (4).
(7) If the Chief Minister appointed in accordance with sub-section (5) fails to receive a vote of confidence or if the Chief Minister fails to be appointed, the Head of the Province shall, on the recommendation of the Chief Minister, dissolve the Provincial Assembly and set an election date so that the election of the next Provincial Assembly is completed within six months.
(8) The procedure related to the appointment of the Chief Minister in accordance with this Article shall be completed within thirty-five days from the date of the announcement of the final result of the election of the Provincial Assembly held in accordance with this Constitution or the date of the Chief Minister becoming vacant.
